Pros and cons of prenuptial agreements

On Behalf of | May 6, 2022 | Prenuptial & Postnuptial Agreements

Contrary to popular belief, it’s not a bad omen to think about divorce before you get married. The state of North Carolina doesn’t have an appreciably higher divorce rate than any other area of the U.S. Part of this equity may be due to the fact that more couples are finally talking about the benefits of a prenup.

The pros of a prenuptial agreement

Having a prenuptial agreement in place may save you from having to go to court to resolve all sorts of tricky and contentious family law issues. One of the best things that bringing up the possibility of a prenup does is force both partners to talk about money. This is an issue that should be front and center.

While a prenup can’t prevent a divorce, it can certainly reduce the cost of one. This is due to the fact that you have an ironclad contract in place that can act as your personal financial safety net. A prenup can save you a lot of time, energy, and money. It can make the process of divorce both faster and easier.

Perhaps the biggest advantage that a prenup will grant you is the power it lets you keep in your own hands. If you get divorced without a prenup in place, this is not the case. A court will be entitled to make decisions as to what’s fair for both parties.

The cons of a prenuptial agreement

In all fairness, it should also be pointed out that a prenuptial agreement may also have some downsides. Having a prenup in place is definitely not a magic trophy that will ward off the possibility of having to get a divorce. For some couples, even discussing the matter before marriage may result in disagreements that end your engagement.

It is also true that a prenup may tend to favor one spouse over the other. This can lead to a relationship whose inequality is exposed during a divorce. However, this doesn’t always need to be the case. You and your partner can work together to make necessary changes.
